EU-U.S. and Swiss-U.S. Privacy Shield Policy

InEvent Inc. (“InEvent”, “we”, “our” or “us”) has subscribed to the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework (collectively, “Privacy Shield”). InEvent adheres to the Privacy Shield Principles including the Supplemental Principles, (collectively, the “Privacy Shield Principles”) for Personal Data received from entities in the European Economic Area (the “EEA”), the United Kingdom (“UK”) and Switzerland.

This InEvent Privacy Shield Policy (“Privacy Shield Policy”) and the InEvent Privacy Policy (“Privacy Policy”) describe the privacy practices that we implement for Personal Data received from the EEA, UK or Switzerland in reliance on the Privacy Shield. This Privacy Shield Policy uses terms which are defined in the Privacy Policy.

If there is any conflict between the terms in this Privacy Shield Policy and the Privacy Shield Principles as concerns the Personal Data received under the Privacy Shield, the Privacy Shield Principles shall govern to the extent of the conflict. Privacy Shield Principles

1. and 2. Notice and Choice

Our Privacy Policy describes how we use Personal Data we receive from different sources. This Privacy Shield Policy describes how we process Personal Data covered by the Privacy Shield.

If you are a User, InEvent may act as an agent for you in relation to the Personal Data that you provide or make available to InEvent. InEvent usually will not have a relationship with your Customers. Here, the User is responsible for ensuring that Customers are provided with appropriate notice and choice with respect to their Personal Data.

In its role as a controller and as required by applicable law, InEvent generally offers individuals in the EU, UK and Switzerland (together: “EEA/UK/CH Consumers”) the opportunity to choose whether their Personal Data may be (i) disclosed to third-party controllers or (ii) used for a purpose that is materially different from the purposes for which the information was originally collected or subsequently authorized by the relevant EEA/UK/CH Consumer. To the extent required by the Privacy Shield Principles, InEvent obtains opt-in consent for certain uses and disclosures of sensitive data. EEA/UK/CH Consumers may contact InEvent as indicated below regarding the InEvent’s use or disclosure of their Personal Data. Unless InEvent offers EEA/UK/CH Consumers an appropriate choice, InEvent uses Personal Data only for purposes that are materially the same as those indicated in this Policy.

3. Data Integrity and Purpose Limitation

We only collect Personal Data that is relevant to providing our Services. We process Personal Data compatible with us providing the Services or as otherwise notified to you. We take reasonable steps to ensure that the Personal Data received under the Privacy Shield is needed for InEvent’s Services, accurate, complete, and current.

4. Accountability for Onward Transfers

This Policy and the Privacy Policy describe how InEvent shares Personal Data.

Except as permitted or required by applicable law and in accordance with InEvent’s role as a controller or processor, InEvent provides EEA/UK/CH Consumers with an opportunity to opt out of sharing their Personal Data with third-party controllers. InEvent requires third-party controllers to whom it discloses the Personal Data of EEA/UK/CH Consumers to contractually agree to (a) only process the Personal Data for limited and specified purposes consistent with the consent provided by the relevant EEA/UK/CH Consumer, (b) provide the same level of protection for Personal Data as is required by the Privacy Shield Principles, and (c) notify InEvent and cease processing Personal Data (or take other reasonable and appropriate remedial steps) if the third-party controller determines that it cannot meet its obligation to provide the same level of protection for Personal Data as is required by the Privacy Shield Principles.

InEvent may disclose Personal Data to trusted third parties as indicated in the Privacy Policy without offering an opportunity to opt out. InEvent requires that its agents and service providers that have access to Personal Data within the scope of this Privacy Shield Policy provide the same level of protection as required by the Privacy Shield Principles. We ensure that our agents process Personal Data received under the Privacy Shield in a manner consistent with our obligations under the Privacy Shield Principles, unless we prove that we are not responsible for the event giving rise to the damage.

We may also need to disclose Personal Data in response to lawful requests by public authorities, for law enforcement or national security reasons, or when such action is necessary to comply with a judicial proceeding or court order, or when otherwise required by law. We do not offer an opportunity to opt out from this category of disclosure.

5. Data Security

We use reasonable and appropriate physical, electronic, and administrative safeguards to protect Personal Data from loss, misuse and unauthorized access, disclosure, alteration and destruction, taking into account the nature of the Personal Data and the risks involved in processing that information.

6. Access to Personal Data

Our Privacy Policy explains how you may access and/or submit requests to review, correct, update, suppress, or delete Personal Data. You can ask to review and correct Personal Data that we maintain about you by sending a written request to privacy@inevent.com. We may limit or deny access to Personal Data where providing such access is unreasonably burdensome, expensive under the circumstances, or as otherwise permitted by the Privacy Shield Principles.

When InEvent acts on behalf of its Users, InEvent will assist Users in responding to individuals exercising their rights under the Privacy Shield Principles.

If you are a Customer of a User, please contact the User directly with your request to access or limit the use or disclosure of your Personal Data. If you contact us with the name of the User to which you provided your Personal Data, we will refer your request to that User and support them in responding to your access request.

7. Recourse, Enforcement and Dispute Resolution

If you have any questions or concerns, please write to us at the address listed below. We will investigate and attempt to resolve complaints and disputes regarding use and disclosure of Personal Data in accordance with the Privacy Shield Principles.

InEvent is committed to resolving complaints about privacy and our collection or use of personal information fairly and efficiently. Individuals should begin by first contacting InEvent. For any unresolved privacy complaints, InEvent has chosen the EU Data Protection Authorities (EU DPAs) and the FDPIC, as applicable to serve as the independent dispute resolution body to address complaints and provide appropriate recourse free of charge to the individual. InEvent has agreed to fully participate in the EU DPAs and the FDPIC procedures to resolve disputes pursuant to the Privacy Shield Framework.

If your Privacy Shield complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other redress mechanisms. 1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us.

In Short: We collect personal information that you provide to us such as name, address, contact information, passwords and security data, payment information, and social media login data.

We collect personal information that you voluntarily provide to us when registering at the Sites or Apps, expressing an interest in obtaining information about us or our products and services, when participating in activities on the Sites or Apps (such as posting messages in our online forums or entering competitions, contests or giveaways) or otherwise contacting us.

Name and Contact Data. We collect your first and last name, email address, postal address, phone number, and other similar contact data.

We may request access or permission to certain features from your mobile device, including your mobile device's calendar, contacts, storage, and other features. If you wish to change our access or permissions, you may do so in your device's settings.

Mobile Device Data

Push Notifications

We may request to send you push notifications regarding your account or the mobile application. If you wish to opt-out from receiving these types of communications, you may turn them off in your device's settings.


Information collected from other sources

In Short: We may collect limited data from public databases, marketing partners, social media platforms, and other outside sources.

We may obtain information about you from other sources, such as public databases, joint marketing partners, social media platforms (such as Facebook), as well as from other third parties. Examples of the information we receive from other sources include: social media profile information (your name, gender, birthday, email, current city, state and country, user identification numbers for your contacts, profile picture URL and any other information that you choose to make public); marketing leads and search results and links, including paid listings (such as sponsored links).


2. HOW DO WE USE YOUR INFORMATION?

In Short: We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent.

We use personal information collected via our Sites or Apps for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests ('Business Purposes'), in order to enter into or perform a contract with you ('Contractual'), with your consent ('Consent'), and/or for compliance with our legal obligations ('Legal Reasons'). To facilitate account creation and logon process with your Consent. If you choose to link your account with us to a third party account *(such as your Google or Facebook account), we use the information you allowed us to collect from those third parties to facilitate account creation and logon process. To send administrative information to you for Business Purposes, Legal Reasons and/or possibly for Contractual. We may use your personal information to send you product, service and new feature information and/or information about changes to our terms, conditions, and policies.

In Short: If you choose to register or log in to our websites using a social media account, we may have access to certain information about you.

Our Sites or Apps offer you the ability to register and login using your third party social media account details (like your Facebook or Twitter logins). Where you choose to do this, we will receive certain profile information about you from your social media provider. The profile Information we receive may vary depending on the social media provider concerned, but will often include your name, e-mail address, friends list, profile picture as well as other information you choose to make public.

Our servers are located in United States. EU-U.S. Privacy Shield Framework:

In particular Company complies with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States and has certified its compliance with it. As such, Company is committed to subjecting all personal information received from European Union (EU) member countries, in reliance on the Privacy Shield Framework, to the Framework's applicable Principles. Company is responsible for the processing of personal information it receives, under the Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf.

With respect to personal information received or transferred pursuant to the Privacy Shield Framework, Company is subject to the regulatory enforcement powers of the U.S. FTC. In certain situations, we may be required to disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.


7. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). 11. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.

California Civil Code Section 1798.83, also known as the 'Shine The Light' law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.
